Terms of Service

1. Acceptance of Terms

By accessing or using the ApptSecure platform ("Service"), operated by ApptSecure ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service. These Terms apply to all users of the Service, including business owners, employees, and any other authorized representatives.

2. Description of Service

ApptSecure provides an automated SMS appointment reminder platform designed for home service businesses. The Service includes customer management, appointment scheduling, automated SMS reminders and follow-ups, two-way SMS conversations, analytics, and related features as described on our website. The Service is provided on a subscription basis with varying plan tiers.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. You must be at least 18 years old and have the legal authority to bind your business to these Terms.

4. Subscription Plans & Billing

The Service is offered through monthly or annual subscription plans. Each plan includes a specified number of customers, SMS messages per month, and features. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan selected). All fees are in US dollars and are non-refundable except as required by applicable law or as explicitly stated in these Terms.

Free Trial: New accounts receive a 14-day free trial. No credit card is required during the trial period. At the end of the trial, you must subscribe to a paid plan to continue using the Service.

5. SMS Usage & Overage Policy

Each subscription plan includes a monthly SMS allowance:

  • Starter: 250 SMS per month
  • Professional: 2,000 SMS per month
  • Business: 7,500 SMS per month

Overage Charges: If you exceed your monthly SMS allowance, additional messages will continue to be sent and will be billed at $0.03 per SMS. Overage charges are calculated based on the number of SMS messages sent beyond your plan's included allowance during each billing cycle. Overage charges will appear as a separate line item on your next invoice.

You can monitor your SMS usage at any time through the dashboard. We will not suspend SMS delivery due to overage — your appointment reminders will continue to be sent without interruption. You are responsible for monitoring your usage and upgrading your plan if you consistently exceed your allowance.

SMS usage resets on the first day of each billing cycle. Unused SMS messages do not roll over to the next month.

6. SMS Compliance (TCPA & CTIA)

All SMS messages sent through ApptSecure are transmitted in compliance with the Telephone Consumer Protection Act (TCPA), the Cellular Telecommunications Industry Association (CTIA) guidelines, and applicable A2P 10DLC registration requirements. ApptSecure handles carrier registration, opt-out management, and quiet hours enforcement on your behalf.

Your responsibilities: You must obtain proper consent from your customers before sending them SMS messages. By adding a customer and scheduling appointment reminders, you represent and warrant that you have received the customer's express consent to receive SMS appointment reminders. You must honor all opt-out requests, which are processed automatically by our platform when a customer replies STOP.

Quiet Hours: SMS messages are not sent during quiet hours (default: 9:00 PM – 8:00 AM in the customer's local time zone), in compliance with TCPA regulations. Messages scheduled during quiet hours are queued and sent after quiet hours end.

7. Acceptable Use

You agree to use the Service only for lawful business purposes related to appointment scheduling and customer communications. You may not use the Service to send unsolicited commercial messages (spam), marketing messages without consent, messages containing illegal or harmful content, or messages that violate any applicable law or regulation. We reserve the right to suspend or terminate your account for violations of this policy.

8. Cancellation & Refunds

You may cancel your subscription at any time through the billing section of your account settings or by contacting us at sales@apptsecure.com. Upon cancellation, your subscription will remain active until the end of your current billing period. No refunds are provided for partial billing periods. Any outstanding overage charges incurred before cancellation remain due and payable.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data and the data of your customers. You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining any necessary consents from your customers.

10. Limitation of Liability

To the maximum extent permitted by law, ApptSecure shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to lost profits, lost revenue, or business interruption. Our total liability for any claim arising from or related to these Terms shall not exceed the total amount you paid to us during the twelve (12) months preceding the claim.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
